1. Acceptance of these terms
By accessing or using FundedMachine’s website or Services, you agree to these Terms of Use and the Risk Disclosure. If you do not agree, do not use the Services. You must be at least 18 years old and legally capable of entering a binding agreement.
2. Educational services only
FundedMachine provides education, mentorship, technical instruction, and implementation support relating to systematic trading workflows. FundedMachine is not a broker, dealer, investment adviser, commodity trading adviser, fund manager, or fiduciary, and does not provide personalized financial, investment, tax, or legal advice.
We do not provide trading signals, copy trading, managed accounts, custody, discretionary trading, or guaranteed funded-account payouts. You remain solely responsible for every trading and financial decision.
3. Applications and enrollment
Submitting an application does not guarantee acceptance, enrollment, access, results, or an invitation to a call. We may accept or decline applications at our discretion, subject to applicable law. Program scope, fees, payment terms, refund terms, and participant obligations may be set out in a separate enrollment agreement presented before purchase. If that agreement conflicts with these website terms, the enrollment agreement controls for the purchased Services.
4. No performance guarantee
Trading results depend on many factors outside our control. Education, automation, backtesting, optimization, mentorship, and implementation support do not guarantee profitability, successful evaluations, account funding, payouts, or avoidance of losses. Past, hypothetical, simulated, and backtested results do not predict future performance.
5. Participant responsibilities
- Provide accurate information during the application process.
- Evaluate whether trading and the Services are appropriate for you.
- Understand, test, monitor, and take ownership of systems you use.
- Maintain your own platform, brokerage, data, and security arrangements.
- Comply with applicable laws and third-party platform rules.
- Use risk capital only and obtain independent professional advice where needed.
6. Intellectual property and permitted use
The Services and their content—including lectures, frameworks, assignments, text, graphics, code examples, branding, and program materials—are owned by or licensed to FundedMachine and protected by intellectual-property laws. Subject to applicable enrollment terms, participants receive a limited, personal, non-exclusive, non-transferable license for their own educational use.
You may not reproduce, resell, publish, share access to, distribute, scrape, reverse engineer, or create a competing product from protected FundedMachine materials without written permission.
7. Acceptable use
You may not interfere with the Services, attempt unauthorized access, introduce malicious code, abuse application or scheduling systems, misrepresent your identity, infringe third-party rights, or use the Services unlawfully. We may restrict access where reasonably necessary to protect participants, systems, rights, or legal compliance.
8. Third-party services
The Services may reference or integrate with NinjaTrader, prop firms, brokers, data providers, Calendly, Discord, Supabase, or other third parties. Their products and rules are controlled by them and may change without notice. FundedMachine is not responsible for third-party availability, decisions, losses, account actions, or terms. No affiliation or endorsement is implied.
9. Disclaimers
To the maximum extent permitted by law, the website and Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, FundedMachine and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or trading losses; lost profits, data, opportunities, evaluations, accounts, or payouts; or losses arising from third-party services, automation, software, connectivity, execution, or market events.
Where liability cannot be excluded, aggregate liability relating to the Services will not exceed the amount you paid to FundedMachine for the specific Services giving rise to the claim during the preceding twelve months, subject to rights that cannot legally be limited.
11. Governing law
These terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Courts located in Ontario will have exclusive jurisdiction, except where consumer-protection law requires otherwise.
12. Changes and contact
We may update these terms by posting a revised version with a new effective date. Continued use after an update constitutes acceptance where permitted by law. Questions may be sent to legal@fundedmachine.com.
